Deprivation of capital in order to claim benefit
My nephew is shortly due to inherit around £50,000.

He is, presently, claiming Incapacity Benefit (non-means tested) and Housing Benefit (means tested).

If he retains the £50,000 in a bank account, it would put him over the capital limit for Housing Benefit; and, therefore this benefit would be stopped.

At the moment he rents a housing association flat.

If he were to use his inheritance to buy a flat, which would be his main residence, would this be interpreted by the DSS as 'deprivation of capital in order to claim Housing Benefit', or would this be allowed because he was acquiring something of value?

If someone could supply me with a tribunal decision that would clarify the matter either way, this would be most helpful.
